-Michael Bourke appeared upon summons to answer the complaint of Mrs, Jane Ryan for forcibly taking possession of her property, and for other acts of gross abuse and insult. It appears from the statement of complainant (who is the widow of the late Mr. Matthew Ryan, of the Fig-Tree Farm, near Wollongong), and from other particulars that have come under our notice, that a few days after the interment of Mr. Ryan, Mr. John Needham, Commission Agent, in Sydney, arrived in Wollongong, having in his possession a will, which had been executed by deceased so far back as September, 1851, and as such will was made prior to deceased's marriage with the above complainant, of course no provision was made for her maintenance in it, Mr. Needham was appointed an executor to the will in conjunction with another, a resident of Wollongong, but that other declining to act, Needham thereupon put in Bourke, the defendant in this case, as a sort of keeper or care-taker of the personal and chattel property of Mr. Ryan, with instructions not to allow any of said property to be removed from the premises. Meantime the widow took measures to have the opinion of' counsel as to her position, which opinion declared the conduct of the parties to be illegal. Mrs. Ryan stated that Bourke remained on the premises about a week without her sanction, that she said nothing to him until she had occasion to send one of the children to a neighbour's house, with a bundle of linen, that the child returned saying that Bourke forcibly took the bundle from her-that she (complainant) remonstrated with Bourke, and took up the bundle ; whereupon the latter snatched it from her with violence, and said he was placed there by the authority of Mr. Needham ; and that he would allow nothing to be removed from the premises ; complainant then got the horse to put in the cart, for the purpose of proceeding to town to claim the protection of a magistrate, when defendant again interfered, and would not allow her to have the horse put in, giving her the most insolent abuse the while, until a neighbour interfered, and put the horse in the cart for her, when she proceeded to Wollongong, and stated her case to Mr. C. T. Smith, J. P., who proceeded to Mrs. Ryan's residence, accompanied by her clergyman, who ordered Bourke at once to leave the premises. Their worships ordered the case to be remanded for a week, for complainant's witnesses, who were not then present.
